Terms of service
1. General information
The Seller is Roman Bemben, conducting the sale of original works of art as a sole proprietor under the business name “Roman Bemben 79 Stopni”, VAT ID / Tax Identification Number: 8161437261 (hereinafter: the “Seller”) located in Poland, Ujazd 32-080, ul. Jurajska 23A/5.. These Terms and Conditions set out the rules for sales, payments, and copyright relating to the works offered for sale. The store offers sales worldwide.
2. Subject of sale
The subject of sale consists of original paintings, handmade by the Seller. Each painting is a unique work and exists in only one copy. The colors of the painting may differ slightly from those shown on screen due to monitor settings.
3. Placing orders
Orders may be placed through the online store or by contacting the Seller via:

Placing an order constitutes acceptance of these Terms and Conditions. The Seller reserves the right to refuse to process an order in justified cases.
4. Prices and payments
Prices are listed in PLN, EUR, USD, and GBP. The final amount depends on the exchange rate applicable at the time of the transaction. Available payment methods:
payment card (Visa, Mastercard)
online payment (Shopify Payments)
traditional bank transfer
BLIK (for customers in Poland)
Payment must be made within 3 business days from the order confirmation. Failure to make payment within this period may result in cancellation of the order.
5. Complaints and damage
The Buyer is obliged to inspect the shipment upon delivery. In the event of damage arising during transport, the Buyer should prepare a damage report with the courier and contact the Seller without delay. Complaints are reviewed individually within up to 14 days.
6. Returns
As unique works, paintings are generally non-returnable unless the parties agree otherwise. In the case of consumer distance sales, a return is possible in accordance with applicable law, provided that the painting shows no signs of use and is returned in undamaged condition. The Buyer bears the cost of return shipping. In the case of international returns, all shipping costs and customs charges are borne by the Buyer.
7. Copyright
The Seller retains full economic and moral copyright to the sold works. The purchase of a painting does not transfer copyright. The Buyer has the right to display the painting and to resell the original. Copying, reproduction, and commercial use of the painting without the Seller’s prior written consent are prohibited. The Seller has the right to use images of the sold painting in the Seller’s portfolio, on social media, and in promotional materials.
8. Final provisions
The Seller reserves the right to amend these Terms and Conditions. In matters not regulated herein, the provisions of Polish law shall apply. Any disputes shall be resolved by the court having jurisdiction over the Seller’s registered seat, without prejudice to any mandatory provisions of the law of the Buyer’s country.
